Title: Anyone know if I have to pay this?
Post by: The Machinist on December 21, 2010, 09:13:45 PM
I was lucky enough to pay a few hundred bucks for a cup of coffee today, and a short chat with the boys in blue.  They wrote Nov. 21/2010 on all my fines, as if they don't know what month it is!  Is this a suttle way of letting me off the hook or do I still have to pay these?

I don't think you have to pay it as it is  their fault for writing it down.  I got a ticket and went and fought it, they scheduled me a trial date fro adult court (I'm only 16 have to go to youth) so I don't have to pay it.  Just go talk to the crown Prosecuter.

Timmies drive through in Airdrie, they were waiting for me at the end.  Saw them as I was paying for my coffee and thinking I should be buying a few more.  I think they used me to nail a few speeders.  Three cars followed me on to the QE2, all three pulled me over, the two at the back pulled two more cars over as they sped past me while I was pulled over.

you wont have to pay.  you can only go early to plead guilty and pay, otherwise you have to go on the specified date if you are pleading not guilty or other.  very seldom will they allow anyone to go early to see the JP as they are usually way too busy.

Go to the JP and have it dropped. The officer who wrote the ticket will be notified and they can re-issue the ticket with the correct dates anytime in the next 6 months.

As for the youth court versus adult court, unless the Crown has already dismissed the charges in their entirety I would be showing up if I were you. I do not believe that violations of the TSA are treated the same as Criminal Code charges and separated by age.

I heard something like that but have never had it happen, also heard they have to hand deliver it... dunno.  don't answer the door if it's cops :D   most times, the ticket has been voided prior to me attending court.  once they misspelled my name, another time there was an error in their criminal code section they wrote down.

The one time I went to court, I had a cert for the speedo showing it was *way* out. The crown didn't want to even talk to me, so I waited until it went into lunch time, then we went in front of the judge. I waited my turn while the crown presented, then when the judge asked if I had anything to say, I said that I had a cert that I'd like to enter into evidence backing my claim that the speedometer was out. He asked if I'd talked to the JP before court, I replied I had tried to, but was impolitely denied. He ripped the crown a new bodily orifice for making him miss lunch instead of finding out that he should have dropped it hours before.

I think a lot of things slip through the system. A ticket is a summons, it is a legal document, if it is filled out with incorrect information, then AFAIK, it is null and void, however their ability to re-issue is a distinct possibility since the offense actually occurred , not that I think most officers would go to the trouble.

What, they nailed you for going too fast on the section by the station before it went to full highway speed?  Sounds like sheriffs, not RCMP :)

A Co-worker of mine got a ticket that had the wrong date on it. He called the detachment and talked to the officer that wrote it. The officer said "opps, guess its your lucky day, consider it void". He didn't even have to attend court.

I had the same thing...got a ticket for speeding, did not really pay attention to it and apparently it had the wrong date. When I went to pay, the lady at the counter said the ticket was scraped because it had the wrong info on it. However when I was leaving she said the cop has 30 days to issue a new ticket. Never got a ticket, do not know how well it would stand up in court though!

I too have gotten a ticket with the wrong date. I actually got a letter in the mail saying it was "squashed" for that reason. so i didnt pay it. call the detachment and tell the officer. he'll scrap it.
