Title: Legal Notification to the Alberta Government and ASRD
Post by: Hi Lo Silver on November 29, 2006, 04:56:15 PM
When I mentioned I was just going to post this on our site (FWS) after a couple of days of mailing the letter, the person that I consulted with recommended I post this all the sites possible just incase somebody else falls into the same position as I may end up in.

After 32 years of four wheeling and watching our Alberta Goverment strip trails away from the 4x4 community I've decided to send this letter out to various people involved in the process . Not knowing how long it will take to arrive on thier desk as it was sent on Sunday afternoon I've decided to go ahead now and openly post this letter for other individuals to keep this in mind if they too had to make the decision of altering thier recreation. If there is any type of response to this letter I'll post it openly on here.

LEGAL NOTIFICATION

TO: Alberta Government
Alberta Sustainable Resources Development

I, Gunther ------ of-------- Calgary Alberta declare that in the event of injury or death while operating an All Terrain Vehicle (ATV) will hold the Alberta Government and Alberta Sustainable Resources Development fully responsible and accountable for such injury and/or death.

Due to the extreme and unreasonable restrictions made on the Alberta trail system for motorized vehicles in excess of 1500 pounds it has caused me to seek alternate means of transportation to enjoy the back country. The abundance of trails designated to ATV’s and the minimal trails designated to the 4x4’s across the province has forced me to purchase and operate an ATV. The ATV is not the vehicle of choice for such recreation by Gunther ------ as I recognize the dangers that could be incurred while using such a vehicle. Had it been my vehicle of choice these legal issues would not be in question. Gunther ------ has owned and operated a 4x4 (jeep) for thirty two (32) years without any such injury and feels it necessary to make alterations in his life due to the direct irresponsible restrictions on 4 x 4’s put forth by the Alberta Government and Alberta Sustainable Resources Development.

Rick Blackwood, Area Manager, Public Lands and Forests Divisions Sustainable Resources Development of the South and Butch Shenfield Area Manager, Public Lands and Forest Division, Sustainable Resources Development for the North of Alberta along with the Alberta Government have taken over and above means to seriously restrict the use of 4x4’s on Alberta’s trail system created over the many years of industrial access and exploration.

On further legal notification Gunther -------’s spouse of 30 years, Brenda ------, will, in the event of death or serious injury to Gunther ------, seek retribution for any loss of wages, legal fees, health and injury costs incurred from the Alberta Government, Alberta Sustainable Resources Development and any and all persons responsible for the decision making in trail usage and restrictions.

Dated at the City of Calgary in the Province of Alberta this 26th day of November, 2006

I like the idea......but it really just sounds like more of the same. In the end the Government will just use our taxes to close all the trails to all users. Can you hold them respondsible? Mabye, maybe not. How much money do you have and how good is your lawyer.

I know it's tounge in check, you know it's tounge in check. But the government has no sense of Ha Ha. I hope it doesn't but it will probly backfire. :?

Free association with this?  "Better close the trails to EVERYONE for their own safety."
