rear output seal woes

I have had to replace a leaky output seal 3 times now, every time the seal is shredded from the c cliprubbing against the seal. In the picture it is part 34 and washer 42. It looks like the aftermarket seals probably sit further back then the factory causing the groove for the clip to sit closer to the seal. My question is since all that clip does is push on the rubber of the seal and not hold any vital components in place can I just scrap it? It justly sits between the seal and the slinger, and its not like the. Seal can just pop out on its own.
