Laws re guarding fender flares

Quick question about the laws re guarding fender flares.

Was gonna cut & fold my 95 DD XJ and just wanted too make sure I'm not asking too be pulled over if I do....

Ps I had a 99 DD XJ  on 31's cut & folded and was never bothered BUT I'm now on 33x12.5 offset rims  and It will be noticeable!!

Technically they need to be covered, in reality it depends on the cop and if you are in the city or not.

I have ran with big tires on offset rims, tread sticks out about 3" from flares, and never been bothered about it by city cops.
Once got pulled over for something unrelated and they never mentioned anything about the flares not covering the tires.


RCMP is a different ball game however, you'll want big mud flaps as a bare minimum.

I drove my XJ for 2 years with the tires sticking out a good 3 inches past my fenders( no mudflaps ta boot!), and have never been pulled over by the pork for it. I used it as my daily driver in that time with a lot of mixed city and highway driving  with no worries. I'm not saying that it won't happen to you, it's  just been my personal experience.

I do however do my best to avoid Red Deer and the Sylvan Lake area as my friends get a lot of heat from the police in those areas for tire coverage, mud-flaps etc.

I've got a modest lift and mine stick out about 2" from the body, also no mud flaps. I think I am right on the limit of what I can get away with, but I drive like an old lady in my rig so I have never been hassled about it.

My understanding of the regulations are that you need to have the tire covered on the top and you should have protection that extends down to the center of the tire at the back either by fender, mud guard or flaps.

I do however do my best to avoid Red Deer and the Sylvan Lake area as my friends get a lot of heat from the police in those areas for tire coverage, mud-flaps etc.

I've heard there are a few RC's in Cochrane that get pretty sticky when it comes to mud flaps.  Also that a few people have taken the "no mud flaps" ticket to court and won because firstly they don't reference the right section of the act, and secondly the requirement for mud flaps does not apply to passenger vehicles (most jeeps & trucks are registered as passenger vehicles if you check your registration slip).

Well I trimmed everything I could without removing the flare.. Re adjuste bump stops and should be golden!

Ps I'd fight the $57 ticket and get a reduction..

I'm lifted about 3 inches and have 12.5 by 33s. My flares cover all but about 2 inches....no problems so far, but the Okotoks pork bellys are always looking to meet quota...excuse me...expectation.  I fling just enough snow, slush, gravel and crud to keep tailgaters off the ol' bumper..that's fer sure.

If you look at section 64.4 it states "A passenger car is not required to have a mudguard"

If you check your registration, you will see that more than likely your vehicle is registered as a passenger vehicle. I think the case can be made that they are truck or off-road vehicles, but when it comes to stict legal definitions I think any ticket for lack of mudguard or flap would get thrown out.

Passenger cars are still subject to having fenders though, section 64.1 is clear if that you have to either have a mudguard or fender that covers the width of each tire.

3/7 rock chips in my window I can attribute to minivans. 3 of the others were transports, the lone one was Rich in waiperous a couple years ago... I need a new windshield.

My tires have stuck out by ~2" on a DD for just over a year now, ~1" for a year before that. I do have pretty big mudflaps in the rear though.
